Which companies and foundations can own Dubai freehold property

A clear ownership brief before a complex acquisition.

    The short answer

A company or foundation name is not enough to establish that it can hold a particular Dubai property. Confirm the proposed owner, its registration jurisdiction, the property and the current registration requirements together. Decide the purpose of the structure with qualified advisers before committing to an acquisition. This is general guidance, not legal or tax advice.

    Your circumstances. Your answer.

    Your Ownership Path

Begin with the owner, the jurisdiction and the intention.

Start with the purpose of the ownership

Before asking which structure to use, explain what it must achieve. Is the concern shared family ownership, succession, governance, an existing corporate investment policy or administration across countries? These are different objectives. A familiar structure may solve one problem without addressing another.

Write down who will provide the purchase funds, who will use the property and who will make decisions about a sale, borrowing or future transfer. If several people are involved, clarify how decisions are authorised. The intended arrangement needs to be coherent before a property contract is prepared.

We can coordinate the property search with your professional advisers. We cannot turn an introductory article into a legal opinion about ownership, tax treatment or succession. The brief should make clear which questions each adviser is being asked to answer.

Keep entity registration and property eligibility separate

An entity may be validly registered in its home jurisdiction without that fact settling whether it can be entered as owner of a specific property. The entity’s legal form, place of registration and current status should be considered alongside the property and the registration authority’s requirements.

Request written, transaction-specific confirmation through the relevant official process and qualified counsel. Do not rely on the fact that an acquaintance bought through a similarly named vehicle. Their entity, property, documents and transaction date may differ from yours.

The Ownership Path tool is deliberately evidence-gated. It records the proposed buyer type, registration and goal. It will not mark a route possible simply because the words “company” or “foundation” appear in the brief. Missing eligibility evidence is a question to resolve, not a favourable assumption.

Map the people behind the proposed owner

A property held by an entity still has people responsible for it. Ask your advisers to identify the authorised signatories, governing body, beneficial ownership information and decision documents relevant to the transaction. Keep names and documents consistent across the entity file, contract and funding process.

Privacy should not be confused with avoiding identification. The transaction parties and regulated professionals may need information about the people behind the structure. Ask what will be disclosed, to whom and for what purpose. A sales claim about confidentiality is not a substitute for that explanation.

If the principal will not attend, discuss authority and signing arrangements early. Counsel should confirm the appropriate documentation and any certification or translation requirements for the actual transaction. We do not provide a universal document checklist as though it applies to every jurisdiction.

    Prepare one coordinated document file

Ask the registering authority, counsel and funding institution for their current requirements. Assemble one coordinated file rather than sending inconsistent versions to different parties. Track the status, expiry and responsible person for each requested document.

The working file may involve entity records, governing documents, resolutions, signatory identification and funding evidence, depending on what the relevant parties request. Treat these as enquiry categories, not a declaration that every item is always mandatory or sufficient.

Before paying a non-refundable amount, settle who the intended buyer is and whether the required approvals and documents can be produced. Changing the proposed ownership late in a purchase can complicate a carefully planned transaction. The precise consequences need professional review.

    What to check

    • Exact legal name and registration jurisdiction
    • Purpose of the structure and intended property use
    • Written eligibility and document confirmation
    • Authority to sign and approve the acquisition
    • Funding route reviewed with the institution

    Think beyond the first purchase

The ownership decision should also consider ongoing administration. Ask who maintains the entity, approves future decisions, keeps records and pays the continuing costs. A structure that is manageable for a dedicated family office may be unnecessarily burdensome for another household.

Discuss succession, changes in control, future borrowing and exit with qualified advisers. Do not assume the property’s ownership form answers all inheritance or cross-border questions. The correct analysis depends on the family, governing documents and applicable law.

A useful conclusion is a written decision record: the chosen route, why it meets the objective, the confirmations relied on and the obligations that continue after transfer. We can keep that workstream aligned with the property acquisition while your advisers remain responsible for their specialist advice.

    Common questions

Can every company or foundation own Dubai freehold property?

This article does not establish blanket eligibility. The specific entity, jurisdiction and property need current confirmation through the relevant official process and qualified counsel.

Does a structure remove identity checks?

Do not treat a structure as a way to avoid identification. Ask the regulated parties what entity, signatory and beneficial ownership information they require.

Should I choose the home or the structure first?

Develop the property and ownership briefs together. Confirm the intended buyer and document route before making commitments that rely on the proposed structure.
